New Employment Laws 2018: Salary History

AB 168 (Eggman) adds a prohibition about asking for salary history from employees.

Specifically, it prohibits all employers (including state and local governments and Legislature) from:

• Seeking salary history information (including comp. and benefits) about applicant for employment.

• Relying on salary history info in determining whether to offer employment or what salary to offer.

• Employer must provide pay scale for position to applicant upon reasonable request.

• Employer can consider/rely on voluntarily disclosed info
